Welcome to The Workers Compensation Board of Manitoba website (the “Website”) or WCB Worker Connect App (the "App"). In this agreement the terms “we”, “our” and the “WCB” refer to The Workers Compensation Board of Manitoba and “you” and “your” refer to you as the individual accessing or using the Website or App on your own behalf and any entity on whose behalf you may be acting. Please note that the terms “Website” and "App" include all information, materials, forms, eForms, products, services, eServices and offers made available by the WCB through the Website or App.

Your use of the Website or App is subject to your acceptance of these terms and conditions (collectively the “terms of use”). By accessing, registering with, uploading materials to or otherwise using the Website or App, you agree, on your own behalf and on behalf of any entity for whom you may be acting, to the terms of use. The WCB logo (the "Logo") is a trademark owned by the WCB. All other trademarks, trade names or service marks are the property of their respective owners.

No Endorsement

Reference to organizations, services, products, processes and events on the Website or App does not imply their endorsement or recommendation by the WCB and any failure to mention a particular organization, service, product, process or event is not a sign of disapproval.

Your use of the Website or App and the WCB’s use and disclosure of your personal information is done in accordance with the WCB's Privacy and Security Statement.

interfere with or disrupt the Website or App, their servers, or networks supporting such, or disobey any requirements, procedures, policies or regulations associated with the Website or App; or
collect or store personal data about other users, except as may be permitted by law.

The WCB may not pre-screen information provided by you or other users. The WCB has the right (but not the obligation) in our sole discretion to remove or move any information that is available on the Website or App. This includes but is not limited to removing any information that violates the terms of use or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any information, including any reliance on the accuracy, completeness, or usefulness of such information.

Permission to Reproduce

Information on the Website and App has been posted with the intent that it be readily available for non-commercial personal and public use. The WCB will determine in its sole discretion whether you have satisfied the above criteria and reserves the right to withdraw its permission. If the WCB exercises this right, you will immediately remove all links to the Website or App.

Use of the WCB Logo as a Link to the Website or App

From your site you may use the Logo as a link to the home page of the Website or App if you are in compliance with the Linking to the Website or App section, you agree to use the Logo in compliance with same, and you agree not to:

adopt, use, register or attempt to register anywhere in the world any logo or mark confusingly similar to the Logo;
do or cause to be done any act or thing, directly or indirectly, contesting or in any way impairing the WCB’s right, title or interest in the Logo;
alter the Logo in any manner, including proportions, colours, elements, etc., or animate, morph or otherwise distort its perspective or two-dimensional appearance;
use the Logo in a manner which displays it in a negative or disparaging manner;
use the Logo as a predominate feature, displaying the Logo larger or more prominently than other company logos; and

The following notice shall accompany the Logo on the page of your site where the Logo appears:

“The Workers Compensation Board of Manitoba's logo is a trademark owned by The Workers Compensation Board of Manitoba.”

Even if you comply with the Linking to the Website or App section and the restrictions and requirements above, the WCB reserves the right to withdraw its permission. If the WCB exercises this right, you will immediately remove the Logo from your site.

Accessibility

The WCB takes the accessibility of the Website by persons with disabilities seriously. Further to The Accessibility for Manitobans Act, the WCB has taken steps to make the Website more accessible. User ID and Password Security

Where provided a password and/or user ID, remember that these are to be kept in strict confidence. You are responsible for maintaining the confidentiality of this information and are fully responsible for all activities that occur through the use of such. You agree to immediately notify your organization and the WCB if: (a) your password and/or user ID are lost or stolen; (b) your password and/or user ID are improperly accessed or used; (c) the security of your password and/or user ID is compromised or in jeopardy of being compromised; or (d) you become aware of any other breach of security.

Account Suspension and Termination

The WCB, in its sole discretion, may, without notice to you, suspend or terminate your user ID and/or password or your access to or use of the Website or App (or any portion thereof), for any reason, including: (a) where the WCB believes that you have violated the terms of use; (b) where your user ID has been inactive for a prolonged period of time; (c) where the WCB believes that you have provided information that is untrue, inaccurate, not current or incomplete; (d) request of law enforcement or government agency; (e) request by you (self-initiated account deletions); (f) unexpected technical or security issues or problems; (g) compliance with legal process; (h) if you have or we believe you have engaged in illegal activities; or (i) nonpayment of any amounts owed by you under The Workers Compensation Act (Manitoba) or Regulations.

WCB Proprietary Rights

You acknowledge and agree the Website and App contain information, materials, forms, eForms, products, services, eServices and offers that are proprietary and confidential to the WCB and its third-party licensors (as applicable). Accordingly, you agree to use such only in accordance with the terms of use and not to disclose such except as authorized by the WCB or as permitted by law.

Data, Telecommunications, and Other Charges

Your use of the Website or App may result in you incurring data, internet, or other charges. Any such charges are solely your responsibility.

Disclaimer and Limitation of Liability

The Website and App are provided to you on an “as is” “as available” basis without warranty, representation, or condition of any kind, whether express or implied, including but not limited to, those of fitness for a particular purpose, title, availability, security, and accuracy. Indemnification

The terms of use shall be governed by and construed in accordance with the laws of the province of Manitoba and the federal laws of Canada. Jurisdiction and venue shall be in Winnipeg, Manitoba, Canada. The WCB's failure to insist upon or enforce strict performance of any right or provision of the terms of use shall not constitute or be construed as a waiver of any right or provision. You agree to use reasonable efforts to do, make, execute, deliver, or cause to be done, made, executed, or delivered all such further acts, documents, and things as the WCB may reasonably require from time to time for the purpose of giving effect to the terms of use. If any provision of the terms of use is found by a Court of competent jurisdiction to be unenforceable, all other provisions shall remain in force and effect.
