Policy Purpose

Under The Workers Compensation Act (the Act), workers who are injured on or after January 1, 1992 are provided wage loss benefits on the basis of loss of earning capacity. This earning capacity may change several times during the period the worker is receiving benefits. This policy describes how, and under what circumstances, the loss of earning capacity will be reviewed and adjusted.

Workers injured prior to January 1, 1992 may also have their benefits adjusted as a result of a review. This would occur where the benefits are paid as rehabilitation benefits under subsection 27(20) or temporary partial disability benefits under subsection 44(2) of the Act as it existed prior to January 1, 1992. This policy describes how these reviews will be conducted.
