POLICY PURPOSE
The Workers Compensation Board (WCB) pays compensation while a worker is totally or partially disabled (for accidents before January 1, 1992) or has a loss of earning capacity (for accidents after December 31, 1991) as a result of the accident.
This policy describes when and how the WCB will pay compensation for statutory holidays that fall within or after the period of disability or loss of earning capacity.
POLICY
1. The WCB generally pays compensation for statutory holidays that fall within the period of disability or loss of earning capacity, except where the statutory holiday falls on a day that the worker would not have worked if s/he had not been injured or the employer pays the worker for the statutory holiday.
If the employer pays the worker for a statutory holiday for which the WCB would pay the worker, the WCB will reimburse the employer for that day at the rate of compensation it would have paid the worker.
2. After a worker returns to work or has been declared fit to return to work, the WCB will not pay compensation for any subsequent statutory holiday.
However, if the day that the worker would return to work or is declared fit to return to work falls on a statutory holiday and the worker returns to work on the following day, the statutory holiday would be considered as part of the disability or loss of earning capacity period.
